  1. 1.       Introduction

These terms and conditions govern your use of the Namrecruit website (http://www.namrecruit.com) hereinafter referred to as the “Website”. By using the Website, you agree to these Terms and Conditions and the Website’s Privacy policy in full. If you do not accept or do not agree with these terms and conditions or any part of these terms and conditions, you must not use the Website. Namrecruit may modify this agreement at any time, and such modifications shall be effective immediately upon posting the modified agreement on the Website.

 

 

  1. 2.        Licence to use website

All rights in/to the content of the Website are reserved and retained by the owners of such rights. Users of the Website are not granted a licence or any other right including without limitation under Copyright, Trade Mark, Patent or Intellectual Property Rights in/or to the content. You may download material from the Website for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from the Website including code and software - except for material explicitly made available for redistribution. You must not use the Website for any purpose that is unlawful or prohibited by these terms of use.

 

 

  1. 3.       Acceptable use

(a)        You must not use our website in any manner that is illegal, unlawful, fraudulent or harmful, or in relation with any illegal, unlawful, fraudulent or harmful purpose or activity; or in any way that causes, or may cause, damage to the Website or impairment of the availability or accessibility of the Website.

(b)        You must not use the Website to copy, store, transmit, host, send, use, publish or distribute any material which consists of or is affiliated to any spyware, computer virus, Trojan horse, worm, keystroke logger, root kit or other malicious computer software whatsoever.

(c)        You must not use the Website in order to transmit, distribute, store or destroy material: in violation of any applicable law or regulation; in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others; that is defamatory, obscene, threatening, abusive or hateful.

(d)        Without our prior express written consent, you must not conduct any systematic or automated data collection activities including without limitation scraping, data mining, data extraction and data harvesting on or in relation to the Website.

(e)        You must not use the Website to send or transmit unsolicited commercial communications.

(f)         You must not use the Website for any objective related to marketing without our prior express written consent.

 

 

  1. 4.       Restricted access

(a)        Access to particular areas of the Website is restricted. At our discretion we reserve the right to restrict access to areas of the Website, or the entire Website.

(b)        To become a registered user, you must provide a password and a login name. You are entirely responsible if you do not maintain the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change your password at any time by following instructions. You may also delete services attached to your registration at your convenience.

(c)        You agree to immediately notify Namrecruit of any unauthorized use of your login name or any other breach of security known to you.

(d)        At our discretion we may disable your user ID and password without notice or justification.

 

 

  1. 5.       User generated content

(a)        In these terms and conditions, “your user content” is to be interpreted without limitation as being material including text, images or other material that you submit to the Website upon registration, during account maintenance or for whatever other purpose.

(b)         You can control how your user content is shared through your privacy settings.

(c)        Your user content must not be illegal or unlawful, must not infringe upon any third party's legal rights, and must not be capable of giving rise to a legal action whether against you or us or a third party under any applicable law in each case.

(d)        You are not permitted to submit any user content to the website that is or has ever been the subject of any threatened, pending or actual legal proceedings or other similar complaint.

(e)        We reserve the right to edit or remove any material submitted to our website, or stored on our servers, or hosted or published upon our website.

(f)         When you delete your user content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

(g)        Notwithstanding our rights under these terms and conditions in relation to user content, we do not undertake to monitor the submission of such content to, or the publication of such content on, our website.

 

 

  1. 6.       Disclaimer

(a)        Namrecruit is a web service which carries job advertisement and resumes content independently published by third parties on the Namrecruit website. Namrecruit is not involved in the recruitment process and must not be considered to be a recruiter and/or employer with respect to the use of the Website. Namrecruit shall not be responsible for any user entering into any agreements or making decisions of whatever nature in connection with the posting of jobs, resumes and/or the contents thereof and/or any other information obtained on the Website.

(b)        Whilst Namrecruit has taken reasonable measures to ensure the integrity of the Website and its contents, no warranty, whether express or implied, is given that the Website will operate error-free or that any files, downloads or applications available via the Website are free of viruses, Trojans, bombs, time-locks or any other data, code or harmful mechanisms which has the ability to corrupt or affect the operation of your system. In no event shall Namrecruit, its suppliers, and/or any third party contributors of material to the Website be liable for any costs, expenses, losses and damages of any nature (whether direct, indirect, punitive, incidental, special or consequential) arising out of or in any way connected with your use of the Website, your inability to use the Website and/or the operational failure of the Website, and whether or not such costs, expenses, losses and damages are based on contract, delict, strict liability or otherwise.

(c)        The Website and its contents are provided on an "as is" basis without any warranties of any kind, either express or implied. Without limiting the generality of this clause, the following warranties are expressly excluded: warranty of merchantability, quality, or fitness for particular purpose, compatibility of the Website with your technology, equipment or software, uninterrupted or error free functionality of the Website, and non-infringement of any rights. Namrecruit makes no representations and no warranties about the accuracy, reliability, completeness or timeliness of the material, services, software, text, and graphics set out on the Website. Insofar as the Website contains links to any other internet websites, you acknowledge and agree that Namrecruit does not have control over any such website and Namrecruit shall therefore not be liable in any way for the contents of any such linked website, nor for any costs, expenses, losses or damages of any nature whatsoever arising from your access and/or use of any such website.

 

 

  1. 7.       Indemnity

You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses, including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers, incurred or suffered by us arising out of any breach by you of any condition of these terms and conditions.

 

  1. 8.       Breaches of these terms and conditions

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem suitable to deal with the breach, including prohibiting you from accessing the website, suspending your access to the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

 

 

  1. 9.       Assignment

We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. We do not permit you to transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

 

 

 

  1. 10.   Exclusion of third party rights

These terms and conditions are for the benefit of you and us, and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in connection to these terms and conditions is not to be subject to the consent of any third party whatsoever.

 

 

  1. 11.   Entire agreement

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in regard to your use of our website, and supersede all prior agreements in respect of your use of this website.

 

 

  1. 12.   Law and Jurisdiction

(a)        If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.

(b)        Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.

(c)        The laws governing this agreement will be the laws in Windhoek, Namibia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Supreme Court of Namibia sitting in Windhoek.
